1.       Definitions 

1.1.    “You” means the legal person subject to these terms and conditions (whether an individual, a company or any other legal entity), and includes anyone reasonably appearing to us to be acting with your authority or permission.

1.3.    ”Fee Return Guarantee” means our guarantee as set out in our website.

2.       General Disclaimer

2.1.    The contents of this website including any information published in it, advice given by email (or otherwise) and related graphics is referred to as the Contents.

2.2.    Free Guide” means one of the leaflets published on our website which are capable of being viewed by You and is referred to as Our    Free Guide Service

2.3.    Our Fixed Fee Legal Advice Service is referred to as our Email Legal Advice Service.

2.4.    All Contents are provided by Churchgate Legal LLP Solicitors of 9 Kings Road, Cardiff, CF11 9BZ.

3.       Jurisdiction

The Contents published in this website are governed by English Law. It is not intended that the website contents be used outside of the jurisdiction of the laws of England and Wales.

The Free Guides published on our website are intended to be for general information purposes only. They do not constitute advice and we give no warranty as to their accuracy. They are not intended to be a substitute for comprehensive legal advice given directly to you by a solicitor and We accept no liability arising out of their use or dissemination.

5.       Email Legal Advice Service

5.1.    The purpose of our Email Advice Service is to provide you with either general or specific advice in relation to your matter, depending upon the level of service you choose.   

5.2      Where We advise You of a dispute concerning a boundary or a Right of Way, the cost does not include any inspection of the land in question and, in certain circumstances, inspection of the land might alter our professional opinion and you acknowledge that we are at liberty to review our opinion upon inspection of the land but that, if you wish us to inspect the land you will have to pay Us for our travelling time and mileage costs at the rate of 43p per mile for our mileage.

5.3.    Whilst we seek to fulfil all requests for advice, it is not always possible to do this due to unusual or complex points of law that your request may reveal. For this reason advice is not available in all circumstances and we reserve the right not to provide you with advice. If you have requested advice but we determine, in our sole discretion, that the complexity of these facts renders advice inappropriate, we will notify you that such advice cannot be provided and refund all monies paid for such advice

5.4.    Whilst we will endeavour to provide you with your written advice within 72 hours following our oral advice we cannot guarantee that it will be done in this time. The advice will normally be sent by email but may in our sole discretion be sent by post.

5.5.    We are obliged by legislation to require sufficient evidence of identity in relation to all new clients.  By using this service you are not clients as such but ‘customers’. However by using this service you warrant that the personal details you provide in the online request form are genuine and relate to yourself (the person using the service) and no one else. You confirm that you will indemnify us for any adverse consequence or loss resulting to us as a result of you being in breach of this clause. 

6.       Exclusion of Liability

6.1.    Churchgate Legal LLP is providing this site on an 'as is' basis and makes no representations or warranties of any kind with respect to this site or its contents and disclaims all such representations and warranties. In addition, Churchgate Legal LLP makes no representations or warranties about the accuracy, completeness, or suitability for any purpose of the Contents published in this site.
