Accountant's Negligence

Most professional negligence claims against accountants fall into two categories:

  • Negligent tax advice
  • Negligent audits

As with all professional negligence claims, in order to recover damages you will have to establish that you were owed a duty of care by the allegedly negligent professional, that duty was breached and as a result, you have suffered financial loss for which the law permits recovery.

To succeed against an accountant you will normally require a report from an expert accountant in support of your claim. As to whether the accountant was, in fact, negligent will judged by the standards of a reasonable accountant undertaking similar work.
